Welcome to HajirHR. Your use of our site, software, and other associated services is subject to terms and conditions. By using HajirHR or accessing it, you understand that you have read and accepted these Terms and that you will adhere to them together with our Privacy Policy and any other policies. These terms aim to give you an understanding of what is expected of you and what you are entitled to whenever you are using our platform.
1. Use of Services
You will only use HajirHR within the boundaries of legal business and according to all the existing rules and regulations. It is your responsibility to make sure that everything you give in the registration process is true and that your logins are safe. Unauthorized use, access or tampering of the platform is strongly prohibited.
We have the right to suspend, restrict, or cancel your access in case:
- Terms or applicable laws are breached.
- Fraudulent, degrading or suspicious conduct is identified.
- The integrity or security of the platform is under threat.
Though we strive to deliver continuous services, we can still suspend or alter services in the case of maintenance, upgrades, or other unexpected circumstances.
2. Accounts & Subscriptions
In order to use the premium features of HajirHR, you are required to create an account and choose a subscription plan that meets the requirements of your organization. All payments will be made according to the selected subscription model, which can be charged monthly, annually, or according to another written contract.
You will make regular subscription payments on a timely basis to have unlimited access to the platform. Failure to make payments before due dates may lead to temporary suspension of your account or termination.
We can also change prices, add new plans or change subscription terms at different intervals. Any change will be notified to you beforehand and will come into effect at the beginning of your next billing cycle except as otherwise indicated.
It is your responsibility to make sure that you maintain a working account and keep your payment details current. Lapses in subscription or expiry of payment methods will not hold HajirHR liable for loss of access or data.
3. Data Ownership & Privacy
You are the owner of the information you post or input in HajirHR. You authorize us to host, store, process and transmit this data to the degree that we require to deliver our services. We will enforce the relevant security controls to secure your information but it is your responsibility to ensure that the data that you control within the platform is accurate and lawful.
Your use of HajirHR is also subject to our Privacy Policy, where we describe the manner in which we collect, use and protect personal and organizational data.
4. Intellectual Property
Intellectual property in the HajirHR platform, such as software, design, code, branding, and content, all belongs to HajirHR or its licensors. You are granted a limited, nonexclusive, nontransferable license right to use the platform in your internal business operations.
You are not allowed to reproduce, alter, distribute, reverse engineer, and use any aspect of the platform without our explicit written authorization. Violation of our intellectual property will lead to lawsuits.
5. Liability & Disclaimer
HajirHR offers its services in their natural states, as they are and as they are available and does not give any warranty of any form, expressed or implied. We are not promising that the platform is going to be error-free, secure and always on.
HajirHR will in no way be held responsible to the maximum extent of the law for indirect, incidental, consequential, or special losses, such as lost profits, loss of data, or even business interruption due to your utilization of the platform.
We will only be liable for any claim to the extent that it does not exceed the total value of the money you paid to HajirHR within the 12 months prior to the occurrence. Certain jurisdictions may not allow some limitations and therefore some of the provisions may not be applicable to you.
6. Termination
We can put a pause on or cancel your access at any moment in case of breach of these conditions, non-payment, or any other activity that can cause harm to the platform or other users. When you are terminated, you will no longer have the right to use the platform.
You can cancel your account at will. Some of the provisions, like those concerning data ownership, intellectual property and liability, will still be used even upon termination.
7. Governing Law & Dispute Resolution
These terms shall be interpreted and ruled by the laws of Nepal without taking into account the conflict of law principles. Any conflict or claim involving these terms will be the sole jurisdiction of the courts in Kathmandu, Nepal.
8. Changes to Terms
We shall modify or change these terms at certain times. Major changes will be reported via e-mail or platform alerts. Continued use of HajirHR following such updates indicates that you have reviewed and agreed to the revised terms.
