1. Acceptance of Terms

By accessing and using the Hajir app (“the App”), you (“the User”) agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the App.

2. Description of Service

The Hajir app provides Human Resource Management (HRM) solutions, including but not limited to employee attendance tracking, payroll management, performance evaluations, and other HR-related functionalities (“the Service”).

3. User Accounts

1. Registration: Users must register for an account to access the Service. You agree to provide accurate and complete information during registration and to update your information as necessary.
2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

4. User Responsibilities

1. Compliance: You agree to use the App in compliance with all applicable laws and regulations.
2. Prohibited Activities: You must not use the App for any unlawful or unauthorized purpose. Prohibited activities include, but are not limited to, violating intellectual property rights, distributing malware, or engaging in fraudulent activities.

5. Privacy and Data Protection

1. Data Collection: We collect and process personal data in accordance with our Privacy Policy. By using the App, you consent to such processing.
2. Data Security: We implement appropriate technical and organizational measures to protect your data. However, no transmission over the internet is completely secure, and we cannot guarantee the absolute security of your data.

6. Intellectual Property

1. Ownership: All content and materials on the App, including software, designs, text, graphics, and logos, are the intellectual property of Hajir or its licensors and are protected by copyright, trademark, and other laws.
2. License: Hajir grants you a limited, non-exclusive, non-transferable license to use the App for its intended purpose. You must not copy, modify, distribute, sell, or lease any part of the App.’

7. Subscription and Payment

1. Fees: Access to certain features of the App may require payment of subscription fees. The fees and payment terms will be specified at the time of purchase.
2. Billing: Subscription fees are billed in advance and are non-refundable. You agree to provide accurate billing information and to update it as necessary.
3. Changes: We reserve the right to change our subscription fees and payment terms at any time. Any changes will be communicated to you in advance.

8. Termination

1. Termination by User: You may terminate your account at any time by contacting us. Upon termination, you will lose access to the App and any data associated with your account.
2. Termination by Hajir: We may terminate or suspend your account and access to the App at our discretion, without notice, for conduct that we believe violates these Terms and Conditions or is harmful to other users of the App, us, or third parties.

9. Disclaimer of Warranties

The App is provided “as is” and “as available.” We make no warranties, express or implied, regarding the App, including but not limited to its accuracy, reliability, or availability. We disclaim all warranties to the maximum extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, Hajir shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the App; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (e) any errors or omissions in any content; and (f) any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the App, whether based on warranty, contract, tort, or any other legal theory, and whether or not Hajir has been advised of the possibility of such damages.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms and Conditions will be brought exclusively in the federal or state courts.

12. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the App. Your continued use of the App following the posting of revised Terms and Conditions means that you accept and agree to the changes.
